Minor Guardianships
When a parent is unable to provide for all the needs of the child, a guardianship may be established. Guardianships do not terminate the rights of biological parents, but instead allows a family to stay in tact except for the purpose for which guardianship is granted. A guardianship designation allows an appointed caregiver to provide whatever level of care is needed, such as access health care services, make schooling decisions or oversee an estate on behalf of a child.
Process for Obtaining a Minor Guardianship

To be granted guardianship powers, you must meet certain criteria established by the court. If you meet these criteria, the court will appoint a guardian ad litem to investigate the best interests of the child. If it is determined that a guardianship is in the child's best interest, it is granted.
The process typically takes 30 to 45 days, but obtaining temporary guardianship during the investigation is possible.

In caring for the elderly, we often suggest establishing property or health care power of attorney or a creating living will prior to a guardianship. However, when it becomes necessary to make decisions for an older person that they may disagree with, guardianship may be the best option.
Filing for a Disabled Adult Guardianship
The process of obtaining a guardianship for a disabled adult is similar to that of minor guardianship. After the petition is filed, the adult facing guardianship is served with notice. At this point, the process may become lengthy as many adults choose to fight against their impending guardianship.
